Was the VA untruthful?
Posted on
I filed for my back in 2005. Denied. Left it go. I filed again this year after many years of deterioration. Denied. The response was I didn't have any treatments, complaints, or diagnosis in my service treatment records. Well, I have them now. I have 2 sick call records about 8 months apart in 2003. In 2004 on a post deployment questionnaire I said I have back pain and muscle aches. In 2005 during an Out-processing questionnaire I listed back pain and muscle aches, and the question if my pain caused me any difficulty in doing my tasks in my MOS, I said yes. In my C&P exam I had told the eximiner I had a 2 pain level on that day. She said my pain wasn't keeping me from doing activities. So denied. Back to the statement that the VA claimed I had "no treatments or complaints." Where I come from, this is a lie. At best we can water it down and call it an inaccurate statement. Am I splitting hairs here with this and I shouldn't be salty about the statement?
