It is finally over! TDIU & P&T

My husband was rated TDIU and then they wanted him to take another PFT (pulmonary function test) We DECLINED to take it and of course advised the VA accordingly via call to the Examiners Office and written statement uploaded to the VA.gov website as part of his claim. We declined due to his respiratory failure history, Stoke and AAA surgery in the past. Many thought we should just show up and decline the test. We did not want to waste the Examiner's time doing that since they already had another test in file for him and at the TDIU exam we also declined a PFT test due to his conditions....Well good news is they did not penalize us for him declining to take that test over. They continued his COPD rating and they ADDED P & T to his disabilities even though he is only 80% total scheduler for all of this conditions. So it can be done, bottom line just lay out everthing in great detail as to why you should be approved and how your conditions are service connected. Highly recommend including your Buddy Statements or LAY Witness statements from your spouse or friend or significant other as to how your conditions impact your life as well as your caregivers life. I did that for my husband in great detail and I know it helped to get his rating.
