Got a question plz..bckgrd info I am a gulf War vet with multiple traumas including mst. I got back from the war and started getting into trouble, missing/late to formations, fighting, got arrested. Current mh diagnoses plus others. I submitted an excellent IME. The examiner said it was as likely as not sc and connected all the dots and said i was 100%. Later VA sent me to a c/p for severity only and the examiner agreed with the IME that I was 100%. Well I just found out that VA requested a records review from the same c/p doc and the VA only wanted an opinion as to whether my claimed condition was incurred in or caused by my disciplinary issues. The c/p doc said less likely than not but stressors like getting arrested can worsen the condition but not cause it. My question is this. If my IME sc my condition as a result of the war why then would VA need to know if my condition was caused by my disciplinary issues? My viewpoint is that I was still on active duty when I got arrested and my symptoms started to manifest upon my return from the war before my arrest so how can VA deny my claim. Or could VA be trying to rule out any other possible causes of my condition? Help I'm biting my nails waiting on my decision letter.
